Účelem tohoto prohlášení o ochraně osobních údajů je informovat vás o zpracování vašich osobních údajů, které shromažďujeme při návštěvě našich webových stránek. Naše praxe v oblasti ochrany údajů je v souladu s právními předpisy nařízení Evropské unie o ochraně osobních údajů (GDPR) a spolkového zákona o ochraně osobních údajů (BDSG). Následující prohlášení o ochraně osobních údajů slouží k plnění informačních povinností vyplývajících z GDPR. Ty jsou uvedeny např. v čl. 13 a násl. GDPR.

Zpřístupnění webové stránky a vytváření logovacích souborů

Při každém přístupu na naše internetové stránky náš systém automaticky zaznamenává údaje a informace z příslušného zařízení (např. počítače, mobilního telefonu, tabletu atd.).

Jaké osobní údaje jsou shromažďovány a v jakém rozsahu jsou zpracovávány?

(1) Informace o typu prohlížeče a jeho verzi;
(2) Operační systém přistupujícího zařízení;
(3) Název hostitele přistupujícího počítače;
(4) IP adresa přistupujícího zařízení;
(5) Datum a čas přístupu;
(6) Webové stránky a zdroje (obrázky, soubory, další obsah), které byly na našich stránkách načteny;
(7) Webové stránky, ze kterých se systém uživatele dostal na naše stránky (referrer tracking);
(8) Informace, zda bylo načtení úspěšné;
(9) Přenesené množství dat

Tyto údaje jsou ukládány do logovacích souborů našeho systému. Nejsou ukládány společně s osobními údaji konkrétního uživatele, takže identifikace jednotlivých návštěvníků není možná.

Právní základ pro zpracování osobních údajů

Čl. 6 odst. 1 písm. f GDPR (oprávněný zájem). Náš oprávněný zájem spočívá v zajištění dosažení níže popsaného účelu.

Účel zpracování údajů

Dočasné (automatizované) ukládání údajů je nezbytné pro průběh návštěvy webových stránek, aby bylo možné stránky zobrazit. Ukládání a zpracování osobních údajů dále slouží k zajištění kompatibility našich stránek pro co nejširší okruh návštěvníků, k boji proti zneužívání a k odstranění poruch. K tomu je nutné zaznamenat technické údaje přistupujícího počítače, abychom mohli co nejrychleji reagovat na chyby zobrazení, útoky na naše IT systémy a/nebo chyby ve funkčnosti stránek. Údaje také slouží k optimalizaci webových stránek a k celkovému zajištění bezpečnosti našich IT systémů.

Doba uchovávání

Výše uvedené technické údaje budou vymazány, jakmile již nebudou potřeba pro zajištění kompatibility stránek pro všechny návštěvníky, nejpozději však 3 měsíce po přístupu na naše stránky.

Možnost vznést námitku a požádat o výmaz

Zpracování můžete kdykoli napadnout dle čl. 21 GDPR a požádat o výmaz údajů dle čl. 17 GDPR. Jaká práva vám náleží a jak je uplatnit, najdete v dolní části tohoto prohlášení o ochraně osobních údajů.

Objednávkový proces

Účelem zpracování údajů je vyřízení Vaší objednávky, abychom mohli realizovat případné smluvní vztahy s Vámi nebo provést předsmluvní opatření.
Doba uložení
Údaje budou vymazány, jakmile již nebudou potřebné pro zpracování objednávky a neexistují žádné zákonné povinnosti uchování. To bývá zpravidla po 10 letech (srov. § 147 odst. 3 ve spojení s odst. 1 č. 1, 4 a 4a AO, § 14b odst. 1 UStG).

Povinnost poskytnutí osobních údajů
Údaje uvedené ve formuláři objednávky nejsou smluvně ani zákonně předepsané, ale jsou nezbytné pro uzavření smlouvy. Pokud nevyplníte povinná pole nebo je vyplníte neúplně, nemůže být Vámi požadovaná objednávka dokončena.
Předání telefonního čísla dopravci
Pokud je dodání Vašeho zboží realizováno prostřednictvím dopravce ve Francii nebo ve Spojeném království, předáváme telefonní číslo uvedené během objednávky dopravci, aby bylo možné doručení.

Proces podání žádosti o zaměstnání

Údaje, které zadáte do polí formuláře žádosti a případně nahrajete, budou kompletně zpracovány za účelem uvedeným níže.
Právní základ pro zpracování osobních údajů
Právním základem pro shromažďování a zpracování údajů uchazečů je čl. 6 odst. 1 písm. b (zahájení smluvního vztahu), čl. 88 odst. 1 GDPR ve spojení s § 26 BDSG. Pokud jsou zpracovávány zvláštní kategorie osobních údajů, které jsou nezbytné k plnění právních povinností podle pracovního práva, práva sociálního zabezpečení nebo sociální ochrany dle čl. 9 odst. 2 písm. b GDPR ve spojení s § 26 odst. 3 BDSG, zpracování probíhá na tomto právním základě. Pokud mají být zpracovány další zvláštní kategorie údajů, vyžádáme si k tomu Váš souhlas dle čl. 9 odst. 2 písm. a GDPR.
Účel zpracování údajů
Účelem zpracování je posouzení a vyřízení Vámi předložených podkladů žádosti.
Doba uložení
Údaje budou smazány, jakmile bude žádost vyřízena a neexistuje žádný oprávněný zájem na uchování údajů. Pokud nedojde k pracovnímu poměru, budou Vaše dokumenty nejpozději po 6 měsících vymazány.

Povinnost poskytnutí osobních údajů
Údaje ve formuláři žádosti nejsou smluvně ani zákonně předepsané, ale jsou nutné k odeslání a zpracování žádosti. Pokud povinná pole nevyplníte nebo vyplníte neúplně, nemůže být žádost odeslána ani zpracována.

Účelem zpracování je přijetí a zveřejnění Vašeho hodnocení na našich webových stránkách a – pokud s tím výslovně souhlasíte – i na internetových platformách našich poskytovatelů hodnocení.
Doba uložení
Vaše hodnocení bude uloženo a zveřejněno na dobu neurčitou. Vyhrazujeme si právo hodnocení kdykoli odstranit bez udání důvodu a bez předchozího či následného oznámení.
Možnost odvolání a vymazání údajů
Svůj souhlas se zveřejněním hodnocení můžete kdykoli odvolat v souladu s čl. 7 odst. 3 GDPR. Zpracování provedené do okamžiku odvolání souhlasu tím však zůstává nedotčeno. Pokud jde o další práva, odkazujeme na přehled na konci tohoto prohlášení o ochraně osobních údajů.
Povinnost poskytnutí osobních údajů
Údaje v rámci funkce hodnocení jsou poskytovány dobrovolně a nejsou vyžadovány smluvně ani zákonem. Kromě toho nejsou tyto údaje potřebné pro uzavření smlouvy. Pokud nevyplníte povinná pole nebo je nevyplníte úplně, nemůže být vámi požadované hodnocení na naší platformě zveřejněno.

Povinnost poskytnutí osobních údajů
Použití kontaktního formuláře je dobrovolné a není smluvně ani zákonně předepsané. Nejste povinni nás kontaktovat prostřednictvím formuláře – můžete využít i jiné kontaktní údaje uvedené na našich stránkách. Pokud však chcete náš formulář využít, musíte vyplnit pole označená jako povinná. Pokud tato pole nevyplníte, nemůžete žádost odeslat nebo ji nemůžeme zpracovat.

Povinnost poskytnutí osobních údajů
Použití přihlašovací oblasti na našich stránkách je smluvně předepsáno pro přístup do chráněné části. Obsah chráněný přihlašovací oblastí nelze používat bez zadání osobních údajů. Pokud chcete použít naši přihlašovací oblast, musíte vyplnit pole označená jako povinná (uživatelské jméno a heslo). Zadání údajů předpokládá existenci uživatelského účtu. Přihlášení není možné, pokud jsou vámi zadané údaje nesprávné. Pokud údaje nevyplníte nebo vyplníte nesprávně, nebude možné používat chráněnou oblast. Zbytek stránky však zůstává přístupný i bez přihlášení.

Formulář pro přihlášení k odběru newsletteru

Jaké osobní údaje jsou shromažďovány a v jakém rozsahu jsou zpracovávány?
Přihlášením k odběru newsletteru na našich stránkách získáváme e-mailovou adresu, kterou jste zadali do přihlašovacího pole, a případně další kontaktní údaje, pokud jste nám je sdělili prostřednictvím přihlašovacího formuláře k newsletteru.

Účel zpracování údajů
Údaje zadané do našeho přihlašovacího formuláře pro newsletter používáme výhradně k zasílání našeho newsletteru, ve kterém informujeme o všech našich službách a novinkách. Po přihlášení vám zašleme potvrzovací e-mail s odkazem, na který musíte kliknout, abyste přihlášení k newsletteru dokončili (Double-Opt-In).
Doba uchovávání
Odběr newsletteru můžete kdykoli zrušit kliknutím na odkaz pro odhlášení, který je uveden v každém newsletteru. Vaše údaje budou ihned po odhlášení vymazány. Totéž platí v případě, že přihlášení nebylo dokončeno. Vyhrazujeme si právo údaje vymazat bez udání důvodu a bez předchozího nebo následného oznámení.

Povinnost poskytnutí osobních údajů
Pokud chcete využívat náš newsletter, musíte vyplnit pole označená jako povinná a potvrdit nám e-mailovou adresu kliknutím na odkaz v rámci Double-Opt-In. Údaje pro přihlášení k newsletteru nejsou potřebné k uzavření smlouvy s námi ani nejsou zákonně vyžadovány. Slouží výhradně k zasílání našeho newsletteru. Pokud nezadáte požadované údaje, nemůžeme vám bohužel náš newsletterový servis poskytnout.

Automatizovaná kontrola úvěruschopnosti / scoring

Pokud s námi chcete uzavřít smlouvu, vyhrazujeme si právo provést výhradně automatizované zpracování vašich osobních údajů za účelem kontroly vaší bonity. K takovému automatizovanému rozhodnutí jsme oprávněni podle čl. 22 odst. 2 písm. a GDPR. Zda může být smlouva uzavřena, závisí na výsledku automatizované kontroly bonity. Při kontrole bonity se vypočítávají statistické pravděpodobnosti platební neschopnosti. Bonitní informace mohou obsahovat pravděpodobnostní hodnoty (scoringové hodnoty), které jsou vypočítány na základě vědecky uznávaných matematicko-statistických metod. Přitom se pomocí různých ukazatelů, jako je příjem, adresa, povolání, rodinný stav a dosavadní platební chování, odhaduje budoucí riziko platební neschopnosti zákazníka. Výsledek je vyjádřen ve formě platební hodnoty (tzv. skóre). Tyto informace jsou základem našeho rozhodnutí o navázání, realizaci nebo ukončení smluvního vztahu. Pokud se domníváte, že jste byli na základě kontroly bonity neoprávněně vyloučeni z uzavření smlouvy, můžete nám svůj názor sdělit e-mailem. Automatizované rozhodnutí pak přezkoumáme individuálně podle čl. 22 odst. 3 GDPR.

Pokud jste si zvolili platební metodu „PayPal“, předáváme vaše při objednávce shromážděné osobní údaje zákazníka za účelem zpracování platby společnosti PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Lucemburk (dále jen „PayPal“). Pokud udělíte svůj souhlas, budou předány následující údaje: jméno a příjmení, ulice, číslo popisné, PSČ, město, datum narození, telefonní číslo a údaje související s vaší objednávkou.

Společnost PayPal při výběru platební metody „PayPal“ provádí kontrolu bonity. Používají se při tom matematicko-statistické metody k výpočtu pravděpodobnosti platební neschopnosti (tzv. výpočet skóre). Společnost PayPal používá takto vypočtené skóre jako základ pro rozhodnutí o poskytnutí konkrétní platební metody. Výpočet skóre probíhá podle vědecky uznávaných metod. Doba uchovávání údajů

Statistické vyhodnocení návštěv této internetové stránky – webové sledovací nástroje

Při přístupu na tuto internetovou stránku nebo na jednotlivé soubory internetové stránky shromažďujeme, zpracováváme a ukládáme následující údaje: IP adresa, webová stránka, ze které byl soubor vyžádán, název souboru, datum a čas přístupu, přenesené množství dat a zpráva o úspěchu přístupu (tzv. webový log). Tyto přístupové údaje používáme výhradně v neosobní formě pro neustálé zlepšování naší internetové nabídky a pro statistické účely. Pro vyhodnocení návštěv této internetové stránky navíc používáme následující webové sledovací nástroje:

Na naší stránce používáme službu Custom Audiences společnosti Meta Platforms Ireland Ltd., Merrion Road, D04 X2K5 Dublin 4, Irsko, e-mail: impressum-support@support.facebook.com, webová stránka: http://facebook.com/ . Předávání osobních údajů probíhá i do USA. V souvislosti s předáváním osobních údajů do USA existuje rozhodnutí Evropské komise o odpovídající ochraně podle rámce EU-US Data Privacy Framework (DPF) ve smyslu čl. 45 GDPR (viz https://commission.europa.eu/document/fa09cbad-dd7d-4684-ae60-be03fcb0fddf_en ). Provozovatel služby je v rámci DPF certifikován, takže předávání odpovídá obvyklé úrovni ochrany dle GDPR.
Právním základem pro zpracování osobních údajů je váš souhlas podle čl. 6 odst. 1 písm. a GDPR, resp. čl. 9 odst. 2 písm. a GDPR, který jste udělili na naší internetové stránce.
Facebook Custom Audience je reklamní nástroj společnosti Facebook, který umožňuje cílené reklamní kampaně směrované na návštěvníky stránek.

Právo na informace
